These Terms and Conditions govern the use of the services provided by the Provider Company, which include SMS and other services that may be introduced in the future. The Company reserves the right to modify this policy at any time. All subscribers of Our Services, directly or indirectly, are required to adhere to acceptable use as per this policy, as modified from time to time.
Acceptance of Terms
By using our website and services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree to these terms, please do not use our services.
Product Usage
Our product, Ceptiv, is provided as described on our website. We reserve the right to modify or discontinue any aspect of Ceptiv at any time without prior notice.
Unlawful Utilization
The Services provided by the Provider Company may only be used for lawful purposes. Transmission, distribution, or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization. The Provider Company will not be held liable for the use of any stolen property by its users.
Users Conduct
Users shall use Company services for lawful purposes only. Subscriber shall not post or transmit any material that violates or infringes upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable. Any conduct that restricts or inhibits any other Subscriber from using or enjoying Company services will not be permitted.
Information Technology Infrastructure and Protection
Violations of system or network security are prohibited and may result in criminal and civil liability. The Company will investigate incidents involving such violations and may involve law enforcement agencies if a criminal violation is suspected. Examples of system or network security violations include unauthorized access, interference with service, and introducing computer viruses into systems or networks.
Compensation
Subscribers agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses arising out of the use of Company Services by the subscriber or anyone else.
Message
Subscribers shall not send unsolicited messages, including commercial advertising and informational announcements. The Company shall not be responsible for the content of the SMS sent or any delays in delivery or non-delivery.
Cost Policy
In consideration of Company forwarding the SMS through its SMS Panel, User shall pay the agreed amount per SMS + taxes sent anywhere within India. Company shall be entitled to charge for all the messages routed by its SMS Panel, irrespective of any delay or non-receipt of the message.
Business User Adherence
Violations of the policy by a Company subscriber or a subscriber’s end user shall be considered a violation of the policy. Any user found violating the Terms and Conditions is liable for action under the prevailing laws, including termination of services without prior notice.
By continuing to use the services, you agree to abide by these Terms and Conditions. If you do not agree with any of the conditions mentioned above, please refrain from using our services. Once payment is received or even if one SMS credit is consumed, the Provider Company will not be liable for a refund of the amount.
